Terms and Conditions (T&Cs) for the Services of Koen Vissers, 3D Artist
1. Scope
These Terms and Conditions apply to all contracts, services, and deliveries between Koen Vissers (hereinafter referred to as “Artist”) and his clients in the field of 3D.
2. Copyright and Usage Rights
a) The Artist retains unrestricted copyright to all 3D artworks created by him.
b) The client acquires only a simple right of use for the agreed purpose. Any further use, especially editing, reproduction, distribution, or public display, requires the explicit written consent of the Artist.
c) The granting of further usage rights is only possible based on a written agreement between the Artist and the client. License fees are due for usage beyond the originally agreed scope.
d) All usage rights remain with the Artist until the invoice has been paid in full. If the usage right is used despite non-payment, this may lead to legal action.
3. Pricing Models
My pricing model for 3D artist services:
a) Daily Rate
High-quality 3D services at a daily rate of 650 euros.
b) Discount Structure
- Up to 4 consecutive working days: no discount.
- From 5 consecutive working days: 5% discount.
- For one month (30 days) of work: 10% discount.
c) Additional Discounts for Long-Term Engagements
- From 2 months (60 days): 15% discount.
- From 3 months (90 days): 20% discount.
- For 6 months (180 days) or more: Individual agreements are available. Please contact me for further information.
d) Notes
- Discounts apply only to contiguous working days or months.
- All prices are exclusive of VAT.
- Customized offers are available for individual projects and long-term engagements.
e) Important
- The discount can only be granted if the duration is determined in advance. For example, if unexpectedly 6 days instead of 4 days are needed, a 5% discount will not automatically be granted.
f) Feedback and Revisions
- Two feedback cycles are included in a fixed price. Any additional revisions will be charged on an hourly basis at a rate of 120 euros per hour.
4. Conclusion of the Contract
a) The Artist’s offers are non-binding and subject to change.
b) A contract is only concluded through written order confirmation or through the actual execution of the service by the Artist.
5. Payment Terms
a) The amount of the remuneration is based on the agreed conditions and is determined in writing before the start of the service according to the established pricing models.
b) Payment of the agreed remuneration is due within 14 days after invoicing, unless otherwise agreed.
c) In the event of default, the client automatically defaults without the need for a reminder. From the time of default, default interest of 5% above the respective base rate is payable.
6. Client’s Responsibility
a) After approval of briefings and drafts by the client, the client assumes full responsibility for any errors and necessary revisions. The Artist is not liable for errors resulting from inaccurate or incomplete information provided by the client.
b) Any costs for revisions that become necessary due to changes or errors after the client’s approval are to be borne by the client.
7. Liability
a) The Artist is liable for intent and gross negligence according to statutory provisions. For simple negligence, the Artist is only liable for the violation of essential contractual obligations.
b) The Artist’s liability is in any case limited to the amount of the contract value.
8. Final Provisions
a) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
b) The place of fulfillment and exclusive jurisdiction for all disputes arising from or in connection with this contract is [Location].
c) Should individual provisions of these T&Cs be or become invalid in whole or in part, this does not affect the validity of the remaining provisions.
